Terms of Service

By accessing or using VineLearn Academy ("the Service") at vinelearn.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and VineLearn Academy. If you are creating an account on behalf of a child under the age of 13, you represent that you are the parent or legal guardian of that child and that you consent to these Terms on the child's behalf.

VineLearn Academy is an AI-powered educational platform for students in Grades 1–12. The Service provides:

• An AI tutoring assistant powered by Google Gemini for Math, ELA (English Language Arts), Science, and Social Studies
• Flashcard generation and practice quizzes
• An XP and level rewards system to encourage continued learning
• A parent dashboard for monitoring children's activity and progress

The Service is intended for personal, non-commercial educational use only.

Parent Accounts

Parent accounts may only be created by individuals who are at least 18 years of age. By creating a parent account, you represent that you are 18 or older.

Child Accounts

Child profiles are created and managed exclusively by parents through the parent account. Children under 13 may not independently create accounts. Parents are responsible for supervising their child's use of the Service and for ensuring compliance with these Terms.

Geographic Availability

The Service is currently intended for users in the United States. We make no representation that the Service is appropriate or available in other locations.

Accurate Information

You agree to provide accurate and complete information when creating your account and to keep that information updated.

Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

One Account Per Parent

Each parent or guardian should maintain only one account. You may not create multiple accounts to circumvent any restrictions.

Permitted Use

You may use the Service only for lawful educational purposes in accordance with these Terms.

Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to circumvent or disable any content filters or safety features
• Use the AI tutor to generate content that is harmful, abusive, harassing, or inappropriate for minors
• Share your account credentials with others
• Attempt to reverse-engineer, scrape, or extract data from the Service
• Use the Service to compete with or copy VineLearn Academy
• Misrepresent your identity or relationship to a child

Content Restrictions

The AI tutor is configured to assist only with academic subjects. Attempts to redirect the AI to off-topic, harmful, or inappropriate content will be blocked. Repeated attempts may result in temporary or permanent account suspension.

Nature of AI Responses

The AI tutor is powered by Google Gemini and is designed to assist with educational content. AI responses are generated automatically and, while generally accurate, may occasionally contain errors or omissions.

Not a Substitute for Professional Advice

The Service is an educational tool and is not a substitute for professional tutoring, academic advising, or other professional services.

Anti-Cheating Policy

The AI tutor is intentionally designed to guide students through problems using scaffolding rather than providing direct answers. This is a core feature, not a limitation.

No Guarantee of Accuracy

We do not warrant that AI-generated content is error-free. Parents and students should verify important academic information through authoritative educational sources.

Our Property

The Service, including its design, software, logos, and educational content, is owned by VineLearn Academy and is protected by copyright, trademark, and other applicable laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.

Your Content

You retain ownership of any content you submit through the Service. By submitting content, you grant us a limited licence to use it solely to provide and improve the Service.

Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without compensation or obligation to you.

"As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Service Availability

We do not guarantee that the Service will be available at all times without interruption. We may suspend, modify, or discontinue the Service at any time with or without notice.

Educational Outcomes

We make no guarantees regarding specific educational outcomes, grade improvements, or academic performance as a result of using the Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VINELEARN ACADEMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS, OR (B) $50 USD.

You may stop using the Service and request deletion of your account at any time by contacting us at support@vinelearn.com.

By Us

We reserve the right to suspend or terminate your account at any time for violation of these Terms, without prior notice. We will make reasonable efforts to notify you of termination except where doing so would be harmful or unlawful.

Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive.

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. If a dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, please stop using the Service.
